Learned A.P.P. states that the Investigating Offcer is desirous of issuing notice under Section 41-A of Cr.P.C. to the applicants, in the wake of the fact that the applicants allege that there is multiplicity of the proceedings at the instance of different complainants, approached them.

Let the notice be issued to the applicants within a period of three days from today, pursuant to which, within 7 days, the M.M.Salgaonkar

2/2 14 ABA-2016-22.doc applicants shall mark their attendance before the Investigating Offcer.

Upon the applicants appearing before the Investigating Offcer, he shall follow the mandate set out under Section 41A of Cr.P.C. and shall record reasons in writing, in case, he comes to the conclusion that the arrest is necessary. Before effecting the arrest for the purpose of custodial interrogation, he shall issue 72 hours notice to the applicants.

With the aforesaid direction, the application stands disposed off.
