Heard learned counsel for parties.

This is an application preferred by the State of Maharashtra for condonation of delay of 353 days in filing the First Appeal challenging the Judgment and award dated 31st March, 2016 passed by the learned Civil Judge, Senior Division, Alibaug in Land Reference No. 361 of 2000(old L.A.R. No.93 of 1989).

Considering the submissions made by the learned AGP for the applicant and the averments made in the affidavit in Pg 1 of 2

12.caf.3648.2017.doc support of the Civil Application, we are satisfied that the applicant has made out a case for passing the following order; (a) The Civil Application is allowed in terms of prayer clause (b) which reads thus:- "(b) this Hon'ble Court be pleased to condone the delay of 353 days in filing the abovementioned First Appeal against the Judgment and Award dated 31.03.2016 passed by the Learned Civil Judge, Senior Division, Alibag in L.A.R.No. 361 of 2000 (Old L.A.R. No. 93/1989 (LAR No. 442/1989)"

(b) The Civil Application stands disposed of accordingly; (c) No order as to costs.
