Appellant No.5 - Mr. Praful B. Kulkarni, who is present in the Court states that the Appellants do not wish to prosecute the Second Appeal. He states that he is making said statement on behalf of all the Appellants.

Mr. Punde states that Appellant No.5 is the Constituted Attorney of all the Appellants. He states that Appellant No.5 has also 1/2

904-sa-758-2007.doc Pallavi filed an affidavit dated 13th June 2023 stating on solemn affirmation that all the Appellants have decided not to prosecute the Second Appeal and seeks to withdraw the Second Appeal. 4.

In view of the above, Second Appeal is allowed to be withdrawn and dismissed as such.

In view of dismissal of the Second Appeal, nothing survives in the Civil Application and the same is also dismissed with no order as to costs.
