The applicant is accused no.10 in Sessions Case No.314 of 2014 for the offences punishable under Sections 307, 120-B and 212 read with Section 34 Indian Penal Code. On 20th April, 2015, the Sessions Court framed charge against the applicant for the offence punishable under Section 212 read with Section 34 Indian Penal Code. According to the applicant, there is no material on record to support the charge against him. Perusal of the statements dtd. 1st August, 2013 of two witnesses i.e. Vinayak Balasaheb Gaikwad and Nitin Somnath Modak clearly indicates existence of the material against the applicant for framing of charge under Section 212 Indian Penal Code. The statements indicate that the applicant had asked his son, the main accused in the sessions case to hide the vehicle used in the offence, in the garage of Nitin Modak. Therefore, the Revision Application is dismissed.
