By an order dated 14th July, 2017, the applicant was granted interim relief.

Heard the learned Counsel for the applicant and the learned APP. Perused the record of investigation. 2.

It is the specific case of the applicant that on the date and time of incident i.e. on 23rd April, 2017 at about 3:00 pm., he was at his sister's place at Thane and was attending a ceremony. It appears from record that there is substance in the defence of the applicant. It further Prima facie appears that mentioning of the name of the applicant 1/2

4-ABA1212-17.DOC in the FIR is an exaggeration. In view thereof, the applicant is entitled to be protected by pre-arrest bail. 3.

Interim relief granted by Order dated 14th July, 2017 is hereby confirmed. However, the condition to attend the Investigating Officer of concerned police station is waived. Application is allowed in aforesaid terms.
