1] The pleadings in the Petition are unsupported by any material where from it can be gathered that Respondent No.5 is under the supervision and control of the State Government. There are no pleadings concerning directive issued by the Government under Section 79-A of the Maharashtra Co-operative Societies Act, 1960 and the Rules of 1961 framed thereunder.
2] Thus, counsel for the Petitioner seeks leave to withdraw the Petition with a right reserved to file a properly drafted Petition should the Petitioner have material to show that Respondent No.5 works under the supervision and control of the State Government. 3] Granting liberty as prayed for, the Petition is dismissed as not pressed.
