The learned counsel for the petitioner submits that the application under Order XXXIX, Rule 11 of the Code of Civil Procedure, 1908 has already been decided during the pendency of this petition. Aggrieved by the said order, the petitioner has already filed Appeal from Order bearing (Stamp) No. 8471 of 2019. In view of this subsequent development, the learned counsel for the petitioner seeks liberty to withdraw the petition with further liberty to raise appropriate grounds in the said Appeal from Order. The writ petition stands disposed of as withdrawn with liberty as sought.
