P.C.:- This is an Application under Section 439 of the Cr.P.C. for bail in CR No 103 of 2018 dated 4/3/2018 registered with Versova Police Station, Mumbai under Section 370 read with section 34 of the Indian Penal Code.

The prosecution case as against the applicant is that he along with other accused persons tried to take two girls out of India on the Passport of the applicant and the Passports issued in favour of the children of the applicant. The Police averted the said crime after receipt of the specific information. The Passport issued in favour of 1/3

the applicant is genuine. It is the case of the prosecution that on the Passports issued in favour of the children of the applicant some other girls were to travel to United States of America and due to proper diligence of the police the said act could not be completed. The record indicates that, it was an attempt on the part of the applicant along with other accused persons to send the said two girls to America. As noted earlier, it was averted by the policed due to their prompt action. The applicant is in jail since 5th March, 2018. The police have already completed investigation and submitted chargesheet. No fruitful purpose will be served by further keeping the applicant in jail.

In view of the above the Applicant can be released on bail. Hence, the following order:- a) The Applicant be released on bail in CR No. 103 of 2018 dated 4/3/2018 registered with Versova Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.

b) After his release from Jail, the Applicant shall attend the Versova Police Station, Mumbai on every 2/3

first Monday of the month between 11.00 a.m. to 1.00 p.m.

c) The Applicant shall attend all the dates before the Trial Court unless precluded for medical reasons. d) The Applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
