The records indicate that by order dated 11/10/2006, the matter was directed to be referred to a Larger Bench. It appears that the said order has not been complied with by the Registry. It further appears that inadvertently, the proceedings came to be dismissed for want of prosecution. The present Application has been moved for setting aside the dismissal order dated 11/02/2021 and to restore the proceedings to its original stage.

In the peculiar facts and circumstances of the case, the Application is allowed in terms of prayer clause (a).
