The petitioners claim to be voters in the election being held to constitute Managing Committee of respondent No.1- Thane District Cooperative Housing Federation. It is stated that there are 791 voters. According to the petitioners, it would be convenient if more than one booth is made available for casting votes by the respective voters who are scattered in Thane, Dombivli, Kalyan, Ambernath, Badlapur and Bhayender areas.

Learned A.G.P., on instruction, submits that with a specific purpose voting is placed at one place, at Thane. The voting would take

skn 2/2 7411.15-wp.sxw place between 9.00 a.m. to 5.00 p.m. and counting would start soon thereafter, on the same day.

Learned counsel appearing for respondent No.1 submits that by consent it was decided that voting would take place at Thane and all the contesting parties had consented for the same. 4.

We find that voting is scheduled on Sunday. It was submitted that parties had consented for having booth at Thane which would be convenient for voters. We do not find any statutory rights are violated in the process. No interference is, therefore, warranted. Petition is dismissed.
