It is an application under Section 24 of the Code of Civil Procedure.

Heard learned Counsel for the parties.

Applicant-wife, seeks to transfer proceeding in Marriage Petition No. 109 of 2017, from the Court of Civil Judge Senior Division, Wardha to Family Court to Pune and

2/3 it be heard alongwith Application No. 779 of 2018 pending before the 14th Family Court, Pune.

The respondent-husband is present in the Court. On instructions from the respondent, the learned Counsel for the respondent submits that the respondent has no objection for transferring the proceedings in Marriage Petition No. 109 of 2017 pending on the file of Civil Judge Senior Division, Wardha to the learned Family Court at Pune.

The applicant has filed maintenance proceedings against the respondent vide application No. 779 of 2018 before the Family Court at Pune and it is pending. 6.

In view of the submissions made by the learned Counsel for the respondents, the application is allowed in term of prayer clause (a).

The proceedings in Hindu Marriage Petition No. 109 of 2017 are transferred from the Court of Civil Judge Senior Division, Wardha to the Family Court at Pune and directed it to be heard alongwith Application No. 779 of 2018, pending before the Family Court-14, Pune.

The learned Family Court-14 shall make an endeavour to dispose of Marriage Petition expeditiously and ensure that hearing of proceedings is not adjourned without reasonable cause.
