CORAM : R.M. SAVANT & M.S. KARNIK, JJ.

DATE : SEPTEMBER 26, 2018.

P.C.:

1.

The above Contempt Petition has been filed alleging contempt of the order dated 31.1.2013 passed by the Division Bench of this Court. By the said order, respondent No. 3 - Education Officer was directed to hear the petitioners and pass an appropriate order in respect of the withdrawal of the approval in respect of the posts held by the petitioners.

1. civil cp 311-18.doc 2.

We are informed by the learned AGP Mrs. Shinde that the earlier incumbent Education Officer had heard the petitioners but the order remained to be passed and thereafter, the said Education Officer has retired. Learned AGP, on instructions of Mr. Sheshrao Bade, Education Officer (Sec), Thane states that the present Education Officer would comply with the said order dated 31.1.2013 by affording hearing to the petitioners and thereafter pass an order. 3.

We accept the statement made by the learned AGP. Learned counsel for the petitioners has no objection to the said course of action being followed. We, therefore, in terms of the statement made by the learned AGP expect the Education Officer to hear the petitioners within two weeks from today and pass appropriate orders within two weeks thereafter.

4.

The above Contempt Petition is accordingly disposed of. To be put up for compliance on 30th October, 2018.
