By this application, the Applicant seeks his enlargement on bail in connection with C.R.No.412 of 2019 registered with the Vile Parle Police Station, Mumbai for the alleged offences punishable under Sections 307, 506II, 504 of the Indian Penal Code, 1860 read with Section 37(1)(3) and 135 of the Maharashtra Police Act. 3.
On instructions, Mr. M.G.Patil, the learned APP for the State, states that trial has commenced and as many as five witnesses 22nd January 2024
16-BA-2212-2022.DOC have been examined. He also states that he has not received copy of the Bail Application although it has been filed in July, 2022. 4.
In the circumstances, I see no reason to keep the bail application pending. The Application is thus, dismissed for want of prosecution. The Applicant is at liberty to renew his prayer for his enlargement on bail, if necessary.
