The Learned APP Mrs. Mhatre tenders the order dated 28-2-2018 passed by the Externing Authority, Deputy Commissioner of Police, Zone-I, Vashi New Bombay. In view of the said supervening event of the order being passed by the Externing Authority, the Learned Counsel for the Petitioner seeks withdrawal of the above above Petition to challenge the said order by way of an Appeal before the Divisional Commissioner, Konkan Division. The above Petition is accordingly allowed to be withdrawn and dismissed as such. Needless to state that the contentions of the Petitioner on merits have not been considered by this Court and it is before the Appellate Authority that the Petitioner would be free to urge the said contentions. The order dated 28-2-2018 is taken on record and marked as "X" for identification.
