P.C. :- After hearing learned Counsel for the parties, we note that the management of the school under which the Petitioner superannuated after working as a Headmaster did not sanction leave sought for by the Petitioner and this resulted in a recovery being effected.

There is no challenge in the Writ Petition to the decision of the management declining leave to the Petitioner.

Counsel seeks leave to withdraw the Petition with right reserved to file a fresh Petition on the same cause but including a challenge to the decision of the management rejecting the leave sought for.
