At the outset, learned counsel for the Applicant seeks leave to withdraw the Application with liberty to file a fresh Application in the trial Court, in view of the subsequent developments i. e. filing of supplementary charge-sheet and grant of bail to the main co-accused. Accordingly, the Application is disposed of as withdrawn with liberty as prayed. If a fresh Application is filed in the trial Court, in view of the subsequent developments as mentioned aforesaid, the learned Judge to decide the same on its own merits uninfluenced by the withdrawal of this Application. It is made clear that this Application has not been heard on merits.
