Heard learned counsel for the petitioner and learned APP for respondent no.1-State.

The prayer made in this petition is for taking penal and strict action against respondent no.2 for illegal termination of service of the petitioner by the letter dated 21 st February 2010, after holding an inquiry, to secure the ends of justice. The prayer itself shows that the petitioner is not sure as to which offence has been prima facie committed by respondent no.2. If petitioner feels that her service has been illegally terminated by respondent no.2, the petitioner would have to challenge her termination order before the appropriate court of law. 1/2 by SNEHA ABHAY DIXIT Date:

Illegal termination of the service of any employee per se does not constitute any criminal offence. The complaint filed by the petitioner with Tardeo Police Station also does not disclose commission of any cognizable offence. In these circumstances, this petition is not maintainable before this court. The petition stands dismissed.

Liberty is granted to the petitioner to take recourse to such other remedy in law as may be available to her for redressal of her grievance in the matter, keeping all questions open.
