Perused the Civil Application. For reasons set out in paragraph Nos.2 and 3, the Civil Application is allowed, the order of dismissal dated 7 th July, 2017 is set aside and the Misc. Civil Application No.60 of 2017 is restored to file. The Civil Application is accordingly disposed of.

The learned Advocate for the Applicant has submitted that though admittedly, the Respondent is residing and working at Navi Mumbai, he has filed the Divorce Petition at Ratnagiri only with an intention to cause harassment to the Applicant. In view thereof, place the Misc. Civil Application No.60 of 2017 for hearing and final disposal on 25 th July, 2017, when the Respondent is directed to remain present before this Court.
