Heard learned Counsel for the parties.
Adv. V. B. Tapkir states that he received instructions to appear on behalf of all respondents. He requires some time to file his vakalatnama. This Application is made by original defendant for condonation of 178 days delay in preferring the Civil Revision Application.
The learned counsel for the Respondent vehemently opposed the Civil Application. He submits that the Applicant has not shown sufficient cause for condonation of delay. Hence, there is no substance in the Civil Application. Same be dismissed with costs.

10 cac 441-15=.doc learned counsel for the applicant, averments made in Civil Application and the law laid down by the Apex Court in the matter of N.Balkrishnan V/s. M. Krishnamurthy (1998) 7 SCC 123, I am satisfied that applicant has made out case for allowing the present Civil Application .
Hence, following order is passed:
a) Delay in preferring the Civil Application is condoned.
b) Applicant to remove all office objections in Civil Revision Application within six weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court. c) Civil application stands disposed off accordingly.
