Prisoner is in jail since 2008. He is seeking benefit of State Remission on account of 125th Birth Anniversary of Dr. Babasaheb Ambedkar.

The learned APP upon instructions states that necessary appraisal report from Court is still awaiting. Counsel for the petitioner submits that the policy is in vogue since long and benefit must be given to petitioner. From 29th November 2008 the petitioner has put in about 12 years as of now and he has been punished with life imprisonment under

2 crwp-2941.18 section 302 IPC. Formal order of his categorization is still not passed. Hence, there is sufficient time to complete the term. We, therefore find that interest of justice can be met with by directing the convicting court to expedite the process and to submit the necessary appraisal and recommendation within a period of six weeks after communication of this order to it. After receipt of said report, the competent authority shall take decision on remission within next 8 weeks. With these directions and with liberty to petitioner to approach again, if his grievance is not redressed, we partly allow this writ petition and dispose it of.

Copy of order be sent to accused in jail.
