Following our interaction yesterday i.e. on 5th October, 2021, Mr.Saket Mone, learned counsel for the petitioners submits on instructions that petitioners would pursue their alternative remedy by filing appeals under section 34 of the Bureau of Indian Standards Act, 2016. He further submits that because of the closure order petitioners have suffered severe financial loss. Therefore, petitioners would also file stay applications alongwith the appeals.

If the petitioners file appeals and stay applications as above, the same may be considered expeditiously by the appellate authority. If for any reason the appellate authority is unable to hear the appeals, the stay applications may be heard within a period of four weeks from the date of filing of the appeals and stay applications.

We make it clear that we have not expressed any opinion on merit and all contentions are kept open.

The two writ petitions are disposed of accordingly with liberty as above.
