The applicant is apprehending arrest in CR No.520 of 2021 registered with Vileparle Police Station, Mumbai for offence u/s.406 of Indian Penal Code.

Learned APP, on instructions of the officer who is present in the Court, submits that investigation in relation to CR No.520 of 2021 is in progress. So far the applicant has not been impleaded as accused in the FIR. The applicant be directed to appear before the Investigating Officer for the purpose of enquiry. In the event it is decided to implead applicant as an accused in the FIR and if it is proposed to arrest him, 72 hours notice in writing would be given to the applicant. The statement is accepted.

In view of aforesaid statement, the application is disposed of with following order :

ORDER

(i) Anticipatory Bail Application is disposed of; (ii) In the event the investigating machinery comes to the conclusion to implead the applicant as an accused and intend to arrest him, 72 hours advance notice in writing be given to the applicant;

(iii) The applicant shall appear before the Investigating Officer on 15th, 16th and 17th September 2021 for the purposes of enquiry/ investigation.
