By this application the Applicant herein has sought to quash the order dated 15th April, 2015 in Criminal Misc. Application No.272 of 2015 whereby the learned Additional Sessions Judge, Sangli, has rejected the application for relaxation of one of the conditions imposed in the bail order dated 2nd January, 2015 in Criminal Misc. Application No.1199 of 2014.

Heard the learned counsel for the Applicant and the learned APP for the Respondent -State.

The records reveal that the Applicant herein was arrested in Crime No.7 of 2014 registered at Kundal police station for the offences punishable under sections 403, 406 and 420 of the IPC. By order dated 2.1.2015 the learned Additional Sessions Judge, Sangli, had ordered to release the Applicant on bail. One of the conditions imposed on the Applicant was to report to Kundal police station once in a month i.e. on the first day of each month, till the conclusion of the trial. The Applicant by the application dated 1.4.2015 had sought to relax the said condition. The learned Additional Sessions Judge has dismissed the said application on the ground that the Applicant is involved in the serious economic offences and that the presence of the Applicant is required before the Trial Court. 4.

It is pertinent to note that the crime is of the year 2014. The charge-sheet was filed on 29.10.2014. It is stated that the trial has commenced and that the Applicant has been regularly attending the hearing of the said case. Considering this aspect, I do not find any reason to direct the Applicant to report to the Police Station on every first date of the month.

Under the circumstances, the application is allowed. The 2/3

impugned order dated 15th April, 2015 is quashed and set aside. The condition imposed by the order dated 2nd January, 2015 to report to the Kundal Police Station once in a month i.e. on the first day of each month, till conclusion of the trial is hereby relaxed. (ANUJA PRABHUDESSAI, J.) 3/3
