The withdrawal of the Petition is sought on the ground that Regular Civil Suit No.6117 of 2012 itself is dismissed in default by the 9th Joint Civil Judge, Senior Division, Pune on 01/11/2019 and the Petition arises out of an order passed on Exhibit 56 in the said Suit on 03/09/2013.

In view of the subsequent development in form of dismissal of Suit, nothing remains for determination in this Petition. The Writ Petition necessarily has to be disposed of as infructuous and stands disposed of as such.
