Mr. Gite, learned counsel for the petitioners, having taken instructions from his client, seeks leave to withdraw the petition with leave to make a representation to the Education Officer, (Primary), Zilla Parishad, Nashik regarding his grievances made in this petition. Leave with liberty as prayed for, is granted. 2.

In the event such representation is made by the petitioner to the Education Officer, Nashik within a period of four

It is made clear that we have not gone into merits of the matter. All points and contentions of the respective parties are kept open. The Education Officer shall decide the representation of the petitioner independently, on its own merits and in accordance with law, and after taking into consideration the decision of the Apex Court in Union of India vs. Natiional Federation of the Blind [(2013) 10 SCC 772] and the Resolution of the State of Maharashtra, General Administration Department dated 8.9.2008. The petition stands disposed of.
