The applicant is seeking pre-arrest bail in Crime No.238 of 2016 for the offences punishable under sections 354, 504, r/w. 34 of the I.P.C.

The main accused Nikitesh Kharat is already arrested and released on regular bail.

The bail of the applicant is opposed by the learned A.P.P. on the ground of criminal antecedents.

The perusal of the contents of the F.I.R. and other material does not call for any custodial interrogation as the attribution against applicant is only that of use of filthy language. Hence, the application is allowed.

10.ABA.1241.16.doc In the event of arrest, the applicant be released on bail on executing P.R. Bond of Rs.50,000/- with one or two sureties in the like amount. The applicant shall attend police station once in every week till filing of the chargesheet. The applicant shall not tamper with the evidence or influence the witnesses.
