MARE, REGISTRAR (JUDL - II) Date : 31th August, 2016 On verification of cause title of First Appeal and its Civil Application with title of original proceedings, it is seen that address of Respondent Nos.1 to 3 and 6 is one and the same. The Notice issued to Respondent Nos.1 to 3 and 6 is received unserved with remark "want of full and detail address". Respondent Nos.1 to 3 were the Applicants in the proceedings before the M.A.C.T., Thane and had mentioned similar address in said proceedings. Likewise present Respondent No.6 was Opponent No.3 before the Tribunal and he was proceeded exparte.
Thus the address of Respondent Nos.1 to 3 and 6 is the same address. Hence, it is evident that Respondent Nos.1 to 3 and 6
cannot be served by regular mode of service. Hence, there is no other way to serve Respondent Nos.1 to 3 and 6 except by way of Publication of Notice in local Newspapers as mentioned in prayer clause of Civil Application.
In view of this, Civil Application is allowed in terms of prayer clause (b). Issue Publication Notice to Respondent Nos.1 to 3 and 6 returnable after 8 weeks.
