1] The offences invoked against the applicant are under Section 384 and 354A of the Indian Penal Code read with 66 and 66A of the Information Technology Act.
2] On the last date of hearing, in terms of the police report, the Investigating Officer was directed to issue notice under Section 160 to the Applicant qua his City Bank Account as allegation is to the effect that some amount has been transferred from the said account. Admittedly, no notice has been issued to that effect to the applicant.
3] The learned APP on instructions from the Investigating Officer states that he shall issue notice under Section 41A of the Cr.P.C. considering the offences which have been invoked in the subject CR. 1/2
(19)ABA-2024-2022.doc Pursuant to the said notice, the applicant shall appear before the Investigating Officer, who shall follow the procedure prescribed under Section 41A of the Cr.P.C.
4] At this stage, since the learned APP submits that correct address of the Applicant is not available, learned counsel for the Applicant submits that the address mentioned in the title clause of the Application is his correct address.
