Learned APP submits that in the present case, trial has commenced. The Special Court is in the process of recording substantive evidence of the complainant. It would not be appropriate to enlarge the applicant on bail in the midst of the trial. Upon considering the submissions of the learned APP this Court is not inclined to grant bail in favour of the applicant. However, Talwalkar 1/2
18. ba1472.16.sxw learned Special Court is requested to make an endeavour to complete recording of evidence as far as possible within 6 months from 1st October, 2016. In view of this, the application stands rejected. It is made clear that the application seeking enlargement on bail has not been heard on merits and hence, the learned Special Court shall not be influenced by the rejection of the present application and shall proceed with recording of evidence in accordance with law. In the eventuality that the substantive evidence of the witnesses is not recorded within 6 months, the applicant would be at liberty to renew the prayer for bail.
The application is disposed of accordingly.
