By this Petition under Article 227 of the Constitution of India, original plaintiff has challenged the Judgment and order dated 6.7.2015 passed by the learned Judge, City Civil Court, Bombay below Exh.23 in Suit No.3626 of 2010. By that order, the learned trial Judge rejected the application filed by the plaintiff for rejecting/discarding the evidence on affidavit of D.W. 1-Rajendra Gala on the

2 / 2 WP/7424/2015 ground that he is claiming as constituted attorney of the defendant and cannot depose in place of the defendant.

After arguing the Petition for sometime, Mr.Vora, seeks permission to withdraw this Petition. Petition is allowed to be withdrawn and is disposed of, as withdrawn.
