1) Learned Advocate for Petitioner fairly conceded to the fact that, without preferring a statutory Appeal against the impugned Order dated 30th May, 2023 passed by the Respondent No.3, the Petitioner has directly approached this Court under Article 226 of the Constitution of India. He submitted that, Respondent No.3 has not taken into consideration the fact that, the Petitioner was earlier also permitted to avail furlough/parole leave. That, the Petitioner will point out the said fact to the Appellate Authority 2) He therefore seeks leave to withdraw the Petition with liberty to file an Appeal against the impugned Order before the Appellate Authority 3) Petition is disposed off with the aforesaid liberty.
