Perused the note submitted by the Office. The appellant no.1 has expired on 11th December, 2013. A perusal of the record further indicates that the appellant no.2 i.e. Dattatraya Dhondiram Thakur has already expired and his name was already deleted vide Ex.16 dated 4th January, 1994 as is apparent in the impugned judgment dated 10th July, 1998. No application has been filed by the legal heirs of appellant no.1 for bringing them on record in place of the appellant no.1. The appeal is thus dismissed as abated.
