This is an application for modification and/or deletion of the condition No.(v) imposed by order dated 27.5.2015 in Bail Application No.128/2015 by the Special Court for NDPS, Greater Mumbai. While releasing the applicant on bail, the learned trial court had directed that the applicant shall surrender his passport with valid visa in the court and the same shall be kept in the safe custody of the Registrar. The learned counsel for the applicant submitted that as a matter of fact passport of the applicant has been lost and for the same he has registered compliant with the Thane Railway

2 /2 APPLN-458-2015 Police being Missing Register Entry No.287/2014. The learned APP has produced the report submitted by the Assistant Police Inspector, Anti Narcotic Cell. Ghatkopar unit wherein said fact has been mentioned after verification.

2) In view of the above, condition No.

(v) in order dated 27.5.2015 passed in Bail Application No.128/2015 is hereby modified to the extent that till the applicant gets fresh pass port the said condition shall not be implemented. It is made clear that as soon as the applicant gets fresh passport the same shall be deposited with the Registrar of the Special Court.

3) Application is allowed in the aforesaid terms.
