CORAM : A.M.BADAR J.

DATED : 16th APRIL 2018.

P.C. :

Heard extensively.

In this case of gang rape, the prosecutrix has stated the incident in tune with the FIR lodged by her which is to the effect that the incident took place when the electric bulb in the room was switched on. The prosecutrix was acquainted with the applicant and the co-accused. She narrated the role played by each of the accused in the offence of gang rape committed on her. My attention is drawn to the several inconsequential aspects which have no bearing over the merits of the case.

Gaikwad RD 1/2

(11)APPANo.9952017 Hence, no case for suspension of sentence and releasing the applicant on bail is made out.

The application is rejected.
