Heard the learned counsel for the parties for the reasons set out in the Civil Application the delay in instituting the appeal is condoned. However, this shall be subject to the payment of cost of Rs.5,000/- in favour of the respondents. Such cost to be deposited within a period of four weeks before the reference Court at Nashik. Upon deposit, the respondent shall be entitled to withdraw the amount of cost unconditionally.
