This application filed under Section 24 of the Code of Civil Procedure (CPC) is for transfer or Hindu Marriage Petition No.1124 of 2013, from the court of 2nd Joint Civil Judge, Senior Division Court, Kalyan, to the court of Civil Judge, Senior Division, Panvel. The applicant has been residing away from the respondent for the last more than two years. There is a child i.e. a avk 1/2
19-MCA-194-2014 daughter, presently aged 3 years, born from the wedlock. According to the applicant, the travel from Panvel to Kalyan takes around 11⁄2 to 2 hours, and consequently, every time she has to attend the court, the entire day is spent only in attending the court. In addition, she also has to look after the three year old daughter, who needs attention. Considering the location of the two places, the time required to travel, and the conveyances available, in my opinion, there is no case made out for the transfer of the marriage petition. The inconvenience claimed cannot be said to be any serious inconvenience. Hence, the application is dismissed.
