This is an appeal impugning an order and judgment dated 7.3.2003 passed by the 25th Metropolitan Magistrate Court, Mazgaon, Mumbai.

I have perused the evidence and the record & proceedings with the assistance of learned APP Ms.Dabholkar for respondent no.3State. 4.

As per the complaint the accused did not produce the KJ

2/2 408.Apeal1253.04.doc records for the period since inception upto March-2001 under Section 45 of the ESI Act. Complainant was unable to even explain the need for inspection of ledger book/records, what was to be inspected or provided. It has been recorded in the impugned order that the accused was present with all records.

In view thereof, the trial Court dismissed the complaint. 5.

I cannot find any fault in the trial Court's order. 6.

Appeal dismissed.
