} Respondent Mr. Anand S. Jondhale and Ms. Yashodha A. Jondhale i/b. M/s. Jondhale and Co. for the petitioner.
CORAM :- S. C. DHARMADHIKARI & DR. SHALINI PHANSALKAR-JOSHI, JJ.
DATED :- August 3, 2016 P.C. :- The petitioner is based at Parbhani. The first respondent bank is functioning at Parbhani. In the first instance, the petitioner filed the writ petition challenging the measures under section 13(4) of the SARFAESI Act before the Aurangabad Bench of this court. That court protected him by an ad-interim order, copy of which is at page 111 of the paper book. Now that the petitioner is aggrieved by an appellate order or a further order of the tribunal, does not mean that a petition would lie before the Principal Seat. It cannot lie before this Bench only on the ground that the appellate authority is at Mumbai. We do not countenance such bench hunting tactics. The petition be J.V.Salunke,PA
