By this civil application, the applicant seeks condonation of delay in filing civil application and for bringing the legal heirs of the respondent no.1(E) on record. No affidavit in reply is filed by the respondents. I have heard learned counsel appearing for the parties and I have perused the record. In my view, the case is made out for condonation of delay and seeking amendment to the second appeal.

For the reasons recorded in the civil application, delay in filing civil application is condoned. The applicant is allowed to carry out amendment in terms of prayer clause (b) within two weeks from today. Civil application is made absolute in the aforesaid terms. No order as to costs. [R.D.
