By the above Miscellaneous Civil Application filed under Section 24 of the Code of Civil Procedure, 1908, the Applicant-wife seeks transfer of Marriage Petition No. 1279 of 2016 filed by the Respondent-husband and pending before the Family Court, Pune to the Family Court at Bandra, Mumbai..

By consent of the parties, the following order is passed: (i) Since both the parties are educated, they have agreed to conduct the proceedings through video conferencing.

(ii) The Family Court, Pune shall conduct the proceedings in Marriage Petition No. 1279 of 2016 through video conferencing. In the event of any

KPPNair -2difficulty, the Respondent undertakes to provide to the Court a laptop, WIFI and other equipments necessary to conduct the proceedings through video conferencing.

(iii) The Family Court at Bandra, Mumbai shall allow the Applicant and her Advocate to use the video conferencing facilities available with the Court to conduct the proceedings in Marriage Petition No. 1279 of 2016 through video conferencing on the dates fixed by the Family Court, Pune. (iv) The Family Court at Bandra shall allow the Applicant to verify / affirm her pleadings / Affidavits to enable her to forward the same to the Family Court, Pune.

(v) The Family Court, Pune, shall endeavour to dispose off the Marriage Petition No. 1279 of 2016 within a period of six months from the date of this order.

(vi) Both the parties agree that they shall not seek adjournments and shall proceed with the matter on the given dates. The Court shall also not grant adjournments to the parties unless absolutely necessary. (vii) Since the proceedings shall be conducted through video conferencing, the Family Court, Pune, shall fix the hearing of the matter at the time specified in advance.

(viii) All contentions of the parties are kept open. (ix) The Respondent undertakes that the cheque of Rs.25,000/- dated

KPPNair -326th September, 2017 issued by him to the Applicant shall be honoured by his bankers upon presentment for payment / encashment. (x) The above Application is accordingly disposed of. (S.J. KATHAWALLA, J.)
