This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The bail is sought inter-alia on the ground of prolong incarceration as an under-trial. It appears that prior to filing of the present application, the applicant had filed Criminal Bail Application No.1248 of 2020 and it was withdrawn on 27 April 2022. Thereafter, application was filed for modification wherein it was stated that the application was not argued on merits and the precipe was filed to withdraw the application with liberty to approach the Sessions Court for bail. 47-BA-2222-2022.odt the applicant is in jail for about 71⁄2 years, the applicant is permitted to file application for bail before the trial Court/Sessions Court. The application is disposed of. In view of disposal of the bail application, interim application stands disposed of.
