The earlier bail application moved by the present applicant/accused came to be decided by this court on 8th June 2016 vide order on Criminal Bail Application No.1086 of 2016. The learned advocate for the applicant/accused attempted to take me through the merits of the matter. However, the earlier similar application moved by the applicant/accused after filing of the charge­sheet was rejected by this court vide order dated 8th June 2016. There are no changes in circumstances warranting avk 1/2

5-BA-1631-2017.doc entertainment of the instant application over rejecting his first bail application filed after filing of the charge­sheet. The fact that the applicant/accused is the sole bread winner in the family and he has children to maintain cannot be construed as change in circumstances. This was the position prevalent when the earlier bail application filed by the applicant/accused was rejected.

In this view of the matter, second bail application filed by the present applicant/accused cannot be entertained. The application is, therefore, rejected.

Considering the fact that charge­sheet was filed long back, the learned trial court is requested to expedite the trial and to finish it within a period of eight months from the date of communication of this order.
