On 22-02-2016, this Court passed the following order : "1.By an order dated 29 th January, 2016, the disputes between the parties were proposed to be referred to Mr. Justice S.R.Sathe (Retd.). However, Mr. Justice S.R.Sathe (Retd.) has conveyed his inability to act an Arbitrator in the matter. The parties now propose to refer their disputes to Retd. A.D.J. Mr. S.J.Padhye. In view thereof, Retd. A.D.J. Mr. S.J.Padhye shall submit disclosure under Section 11(8) read with Section 12(1) of Arbitration and Conciliation Act, 1996.

2. The Advocates for the parties shall forward a copy of this order to Retd.

A.D.J. Mr. S.J.Padhye.

3. All concerned to act on an ordinary copy of this order duly authenticated by the learned Associate of this Court".

Pursuant to the above order, Mr. S.J.Padhye has filed disclosure under ssp 1/2

arp 62 of 2015 (928).sxw Section 11(8) read with Section 12(1) of the Arbitration and Conciliation Act, 1996. The same is taken on record and the following order is passed by consent : i.

The disputes between the parties arising out of Agreement dated 03-022009 are referred to the sole Arbitration of Mr. S.J.Padhye, Retd. A.D.J. ii.

The parties shall appear before the learned Arbitrator in his chambers, on th March, 2016 at 11.00 a.m. and obtain necessary directions. iii.

The cost of arbitration shall initially be borne by the parties equally. iv.

All contentions of the parties are kept open. v.

The venue of Arbitration shall be at Pune.

In view of this order, the above Arbitration Petition is disposed of. ( S.J.KATHAWALLA, J. ) ssp 2/2
