This application is preferred by defendant for condonation of 7 days delay in challenging the judgment and decree dated 28.04.2014 passed by Bombay City Civil Court, Mumbai in S.C. Suit No. 8011 of 1998 (High Court Suit No. 2553/1998). Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

a) Civil Application is allowed in terms of prayer clause (b) which reads thus :
