The learned APP on instructions from the Investigating Officer submitted that in pursuance of the order dated 26.7.2016 the applicants have attended the Investigating Officer and joined the process of investigation. The learned APP on instructions further submitted that the custodial interrogation of the applicant is not necessary.

The learned APP has produced before me the papers pertaining to investigation of the present crime. After taking into consideration the statements of the children namely, Rishabh aged 17 years, Rohit aged 16 years and Rahul aged 14 years of deceased Smt. Anita Vinodkumar Gaur & applicant no. 2 Vinodkumar Gaur, it clearly appears to the Court that the custodial interrogation of the applicants is not necessary.

In view of the above, the interim relief granted by the order dated 26.7.2016 is hereby confirmed.

The applicants are hereby directed to attend the Investigating Officer as and when called for between 11.00 a.m. to 1.00 p.m. for the purpose of investigation till the filing of chargesheet. It is needless to mention that before calling the applicants to the police station, the concerned Police Officer shall issue a notice under section 160 of Cr.P.C. to them.
