By this application, the applicant has sought to condone the delay of 21 days in filing the second appeal. The learned Counsel for the respondent submits that the applicant has not made out sufficient grounds for condoning the delay.

I have considered the submission of the learned Counsel for the applicant and the averments made in the application. In my pps
10 cas 858-17.doc considered view, the reasons stated in paragraph nos. 2, 3 and 4 of the application constitute sufficient grounds to condone the delay. Hence, the delay is condoned. Application is allowed in terms of prayer clause (a).
