P.C. :- 1] This petition is directed against order dated 28 May 2013 made by the Additional Commissioner, Konkan Division in Revision Petition No.23 of 2010.

2] Learned counsel for the petitioner admits that as against the impugned order, further revision application would be maintainable before the State Government. Accordingly, there is no reason to entertain the present petition.

3] If the petitioner institutes a revision petition before the State Government within a period of three weeks from today, then in considering the same, the period between the date of filing of the 1/2

DSS 26-wp-7210-13 present petition and the date of this order, shall be considered for exclusion. Further, for a period of three weeks from today, the interim order made in the present petition shall continue. 4] It is clarified that this Court has not gone into the merits of the matter and all contentions of all parties are kept open for the decision by the State Government in the revision application, in case, the same is instituted.

5] With the aforesaid observations, present petition is disposed of.
