3. By the present Petition, Petitioner has prayed for following reliefs:- "

a.

by an appropriate writ, order or direction, this Hon'ble Court be pleased to quash and set aside the order passed by the Minister for Dairy Development, Mantralaya, Mumbai, dated 5-4-1999 thereby accepting the proposal of the Respt.No.4-society for registration;

b.

by an appropriate writ, order or direction, this Hon'

ble Court be pleased to set aside Order passed by the Respondent No.5 dated 27-5-1999 thereby refusing to grant registration to the Petitioner'

s society and further be pleased to direct the Respondent No.5 to grant registration to the Petitioner-society;"

4. Insofar as prayer clause (a) is concerned by interim order dated 18.6.1999 this Court had directed the Respondent No.5 to consider the proposal submitted by Respondent No.4 - Society in accordance

216 wp.3712.99.doc with law. Insofar as prayer clause (b) is concerned, it was Petitioner' s case that the order dated 27.05.1999 refusing the grant of registration to the Petitioner - Society be set aside.

Ms. Nimbalkar has placed on record communication dated 07.12.2022 issued by Assistant Registrar (lgk ̧;d fuca/kd) - Respondent No.5 addressed to the AGP, High Court, Mumbai which states that as on date in village - Surul, District - Sangli there is only one Society by the name of Laxmi Mahila Sahakari Dudh Sanstha Maryadit i.e. Respondent No.4 which is in operation. The said letter further states that pursuant to Government Resolution dated 04.01.2000 issued by the State Government, the Government has now specifically issued directions for operation and registration of more than one dairy society in one village and in view thereof it will now be open to the Petitioner to apply to the competent authority for seeking registration of its society in the said village.

6. In view of the above Government Resolution, learned AGP submitted that the present Writ Petition has become infructuous. Petitioner if she so desires can apply for seeking registration of her society under the above Government Resolution dated 04.01.2000.
