1] The petitioner challenges a notice (Exhibit "D"), issued by the respondent corporation under Sections 261, 264 and 267 of the Maharashtra Municipal Corporations Act, 2012, 2] Counsel appearing on behalf of petitioner submits that if the respondent corporation do not press the said notice, then the petitioner would make an application for regularization of the subject structure.
3] Learned counsel appearing on behalf of Corporation 1/2
8a WP 7940 OF 2015.odt submits that if the petitioner approaches and makes an application, the same will be dealt with in accordance with law and the same shall be decided as expeditiously as possible. 4] In view of statements made, without expressing any opinion, we observe that in case if an application is filed for regularization within two weeks from the date of this order, the Corporation to take appropriate decision within four weeks thereafter.
5] In this view, the impugned notice is not pressed by respondent corporation. The petition is disposed of. All issues are kept open.
