Shinde attached to Vashi Police Station, Navi Mumbai submitted that, in the present case i.e. R.C.C. No. 1329 of 2017, the trial has already began and the learned Judge of the trial Court has posted said matter for recording of evidence of the witnesses.

2) In view thereof, present Application for quashing of F.I.R. No.168 of 2017, does not survive and is accordingly disposed off, by reserving the remedy to contest said R.C.C. No.1329 of 2017 in favour of the Applicant.
